Ace\u0219tia ar urma s\u0103 primeasc\u0103 automat copiile actelor care le prezint\u0103 acuza\u021biile \u0219i propunerile de arestare.<\/p>\n<p align=\"justify\" id=\"p-1\">Ini\u021biatorii spun c\u0103 modific\u0103rile sunt necesare pentru a corecta practici neunitare \u0219i pentru a proteja drepturile fundamentale ale celor ancheta\u021bi. Ei sus\u021bin c\u0103 actuala legisla\u021bie las\u0103 loc unor abuzuri \u0219i lipsuri de transparen\u021b\u0103 \u00een anchete. \u201ePractica judiciar\u0103 este \u00een prezent \u00eemp\u0103r\u021bit\u0103: unii suspec\u021bi primesc acest proces-verbal, al\u021bii nu \u00eel primesc, f\u0103r\u0103 s\u0103 existe vreun fundament de ordin legislativ\u201d, se arat\u0103 \u00een <a href=\"https:\/\/www.senat.ro\/Legis\/Lista.aspx?cod=27209&amp;pos=0&amp;NR=b556&amp;AN=2025\" target=\"_blank\" rel=\"noopener\">Expunerea de motive<\/a>.<\/p>\n<h2 align=\"justify\" id=\"chapter-0\"><strong>Comunicarea obligatorie c\u0103tre suspec\u021bi a documentelor-cheie din anchete<\/strong><\/h2>\n<p align=\"justify\" id=\"p-2\">Parlamentarii consider\u0103 insuficient\u0103 actuala informare verbal\u0103 a suspectului. Legea nu oblig\u0103 organele judiciare s\u0103 \u00eei ofere acestuia o copie scris\u0103 a acuza\u021biilor. \u201eSimpla lecturare a faptei nu satisface cerin\u021bele \u0219i gradul de exigen\u021b\u0103 impus de Conven\u021bia European\u0103 a Drepturilor Omului\u201d, precizeaz\u0103 deputa\u021bii USR.<\/p>\n<p align=\"justify\" id=\"p-3\">Modific\u0103rile ar obliga organele de urm\u0103rire penal\u0103 s\u0103 comunice procesul-verbal de aducere la cuno\u015ftin\u0163\u0103 a calit\u0103\u0163ii de suspect. De asemenea, vor trebui s\u0103 transmit\u0103 \u0219i procesul-verbal prin care este adus\u0103 la cuno\u0219tin\u021b\u0103 calitatea de inculpat. Proiectul impune \u0219i comunicarea referatului cu propunerea de arestare preventiv\u0103. \u00cen plus, inculpatul va primi \u0219i referatul cu propunerea de prelungire a arest\u0103rii.<\/p>\n<p align=\"justify\" id=\"p-4\">Potrivit deputa\u021bilor USR, situa\u021biile actuale pun persoanele anchetate \u00eentr-o pozi\u021bie dificil\u0103: \u201eaproape toate mijloacele de prob\u0103 au fost administrate (\u2026) iar persoana devine suspect \u0219i, la interval de c\u00e2teva minute, inculpat (\u2026) fiind lipsit\u0103 de posibilitatea de a-\u0219i formula ap\u0103rarea\u201d.<\/p>\n<h2 align=\"justify\" id=\"chapter-1\"><strong>Cum func\u021bioneaz\u0103 sistemul \u00een prezent<\/strong><\/h2>\n<p align=\"justify\" id=\"p-5\">\u00cen prezent, faptul c\u0103 aceste documente nu sunt comunicate automat suspec\u021bilor \u0219i inculpa\u021bilor ofer\u0103 anchetatorilor un avantaj important \u00een fazele sensibile ale investiga\u021biilor. Neav\u00e2nd acces imediat la procese-verbale detaliate sau la referatele de arestare, persoanele cercetate nu pot afla pe loc direc\u021bia anchetei, probele administrate ori martorii implica\u021bi.<\/p>\n<p align=\"justify\" id=\"p-6\">Aceast\u0103 lips\u0103 de informa\u021bii reduce riscul ca suspec\u021bii s\u0103 \u00ee\u0219i sincronizeze declara\u021biile, s\u0103 influen\u021beze martori sau s\u0103 compromit\u0103 probe. Totodat\u0103, permite procurorilor s\u0103 \u00ee\u0219i p\u0103streze strategia de investiga\u021bie confiden\u021bial\u0103 p\u00e2n\u0103 c\u00e2nd dosarul este suficient de solid pentru a rezista eventualelor contest\u0103ri.<\/p>\n<h2 align=\"justify\" id=\"chapter-2\"><strong>Motiva\u021bia practicii actuale<\/strong><\/h2>\n<p align=\"justify\" id=\"p-7\">Necomunicarea acestor documente \u00een faza incipient\u0103 a anchetei a func\u021bionat, p\u00e2n\u0103 acum, ca o form\u0103 de protec\u021bie necesar\u0103 pentru investigarea eficient\u0103 a faptelor grave.&nbsp;Mecanismul este esen\u021bial mai ales \u00een marile anchete de corup\u021bie sau criminalitate organizat\u0103. \u00cen aceste cazuri, documentele interne pot con\u021bine sute de pagini cu detalii operative.<\/p>\n<p align=\"justify\" id=\"p-8\">Nerespectarea obliga\u021biilor de comunicare poate genera nulit\u0103\u021bi, anularea m\u0103surilor preventive sau excluderea unor probe.<\/p>\n<h2 align=\"justify\" id=\"chapter-3\"><strong>Provoc\u0103ri \u00een marile investiga\u021bii<\/strong><\/h2>\n<p align=\"justify\" id=\"p-9\">USR sus\u021bine c\u0103 aceste lipsuri produc \u201ev\u0103t\u0103m\u0103ri procesuale\u201d suspec\u021bilor \u0219i inculpa\u021bilor, afect\u00e2nd dreptul la ap\u0103rare.<\/p>\n<p align=\"justify\" id=\"p-10\">Ini\u021biatorii recunosc c\u0103 cele mai mari probleme apar \u00een anchete complexe, unde sunt cercetate fapte multiple \u0219i numeroase persoane. \u00cen dosarele instrumentate de DNA \u0219i DIICOT, un simplu proces-verbal de aducere la cuno\u0219tin\u021b\u0103 a calit\u0103\u021bii de suspect \u201epoate \u00eensuma \u00eentre 300 \u0219i 400 de pagini\u201d, iar aceste structuri \u201erefuz\u0103 uneori s\u0103 comunice\/ remit\u0103 suspectului un exemplar\u201d al documentului.<\/p>\n<h2 align=\"justify\" id=\"chapter-4\"><strong>Suspec\u021bii din dosarele de corup\u021bie, trata\u021bi diferit <\/strong><\/h2>\n<p align=\"justify\" id=\"p-11\">Pentru a ilustra diferen\u021bele de tratament, deputa\u021bii compar\u0103 situa\u021bia unui suspect cercetat pentru o fapt\u0103 simpl\u0103 \u2013 precum conducerea sub influen\u021ba alcoolului \u2013 cu situa\u021bia unui suspect dintr-un dosar de corup\u021bie.<\/p>\n<p align=\"justify\" id=\"p-12\">\u00cen primul caz, sus\u021bin ei, persoanei i se cite\u0219te acuza\u021bia \u0219i \u201ei se comunic\u0103 un exemplar de pe procesul-verbal [\u2026] pentru a-\u0219i preg\u0103ti minima ap\u0103rare\u201d. \u00cen al doilea caz, de\u0219i acuza\u021bia poate avea sute de pagini, faptele sunt prezentate sumar. Suspectul \u201enu prime\u0219te un exemplar de pe procesul-verbal de aducere la cuno\u0219tin\u021b\u0103\u201d pentru a-\u0219i construi ap\u0103rarea.<\/p>\n<h2 align=\"justify\" id=\"chapter-5\"><strong>Marii suspec\u021bi, discrimina\u021bi<\/strong><\/h2>\n<p align=\"justify\" id=\"p-13\">\u201eCum am putea aprecia c\u0103 cele dou\u0103 categorii de suspec\u021bi anterior prezentate beneficiaz\u0103 de acelea\u0219i drepturi \u0219i garan\u021bii procesuale?\u201d, \u00eentreab\u0103 parlamentarii USR. \u00cen opinia lor, \u201eeste mai mult dec\u00e2t evident faptul c\u0103 cea de a doua categorie este discriminat\u0103 \u00een raport cu prima\u201d.<\/p>\n<p align=\"justify\" id=\"p-14\">Ini\u021biativa se afl\u0103 \u00een procedura standard de consultare. Sunt a\u0219teptate avizele de la Consiliul Economic \u0219i Social, Consiliul Legislativ \u0219i Consiliul Superior al Magistraturii. Guvernul, de asemenea, \u00ee\u0219i va exprima punctul de vedere asupra modific\u0103rilor solicitate de parlamentarii USR.
