Condi\u021bionarea accesului la un loc de munc\u0103 de acceptarea unei astfel de test\u0103ri creeaz\u0103 un tratament diferen\u021biat \u00eentre candida\u021bi pe criterii care nu au leg\u0103tur\u0103 cu aptitudinile profesionale sau cu capacitatea de a \u00eendeplini atribu\u021biile postului<\/strong>\u201d, arat\u0103 BNS.<\/p>\n<p id=\"p-3\">BNS mai sus\u021bine c\u0103 legisla\u021bia muncii permite angajatorilor s\u0103 solicite doar informa\u021bii relevante pentru verificarea aptitudinilor profesionale, iar testele poligraf dep\u0103\u0219esc acest cadru \u0219i ridic\u0103 probleme de conformitate cu regulamentele privind protec\u021bia datelor cu caracter personal.<\/p>\n<p id=\"p-4\">Sindicali\u0219tii atrag aten\u021bia c\u0103 refuzul unui candidat de a participa la o astfel de testare nu ar trebui s\u0103 poat\u0103 fi folosit ca motiv de excludere din procesul de recrutare.<\/p>\n<p id=\"p-5\">\u00cen acest context, BNS cere Inspec\u021biei Muncii s\u0103 verifice \u0219i s\u0103 sanc\u021bioneze utilizarea testelor poligraf \u00een recrutare, Autorit\u0103\u021bii Na\u021bionale de Supraveghere a Prelucr\u0103rii Datelor cu Caracter Personal s\u0103 analizeze legalitatea prelucr\u0103rii datelor, iar Consiliului Na\u021bional pentru Combaterea Discrimin\u0103rii s\u0103 evalueze posibilele practici discriminatorii.
